These Terms & Conditions (“Terms”) apply to all users of the Ashes 2 Stone website and to anyone who purchases our services.
By using our website or placing an order, you agree to these Terms. Ashes 2 Stone (“we,” “our,” or “us”) reserves the right to update these Terms, services, or pricing at any time without prior notice. The Terms in effect on the date of your purchase are the Terms you accept.
1. Ashes 2 Stone Commitment
When you purchase solidified remains (“Zen Stones”) from us, we make the following commitments:
1. Return to Ash Guarantee. If, within 30 days of receiving your Zen Stones, you are not satisfied, you may return 100% of the stones. We will process them back into ash-like form and return them to you, less applicable shipping charges.
2. 100% Individual Processing. Your order is handled separately. We never mix remains. Each order is tracked using secure barcode technology.
3. Step-by-Step Updates. You will receive email and/or text notifications at key stages, from receipt of remains through final delivery.
2. Order Process
After payment, we will send you a cremated remains collection kit. You will place the ashes into the provided bags, wrap them securely, and ship them to us using the USPS cremated remains box.
Once received, your remains will be processed at one of our laboratory locations into Solidified Stones and returned to the address on file for your order.
3. Cancellation Policy
We may, at our discretion, decline or cancel an order before processing begins. If this happens, we will return the remains to you along with a full refund. This is your sole remedy for any canceled order.
4. Acknowledgements & Limitations
By using our services, you acknowledge and agree to the following:
- Shipping Risk. Mailing remains is done at your own risk. While USPS offers reliable service, it is not under our control. We strongly recommend purchasing shipping insurance. We are not responsible for lost or mis-shipped remains. Your remedy in such cases is to file a claim with USPS or the insurer you selected.
- Address Changes. You are responsible for keeping your shipping address up to date. We are not responsible for delivery to an outdated address if you did not notify us in writing of the change.
- Timing. We strive to complete and return Zen Stones within 6–8 weeks of your order. However, we are not liable for delays.
- Variations. Because the process depends on the natural composition of remains, we cannot guarantee specific colors, shapes, textures, or appearances. Variations such as bubbles, pits, cracks, or uneven color are natural and not considered defects. By placing an order, you accept these natural variations.
- Age Restrictions. Our website and services are for individuals age 18 or older. We do not knowingly collect personal information from anyone under 18. If you are 13–17 years old, you must have a parent or guardian’s consent, and they must agree to these Terms on your behalf. Children under 13 may not use our site or provide personal information.
- Geographic Limitations. We provide services only within the United States and Canada.
5. Intellectual Property
“Ashes 2 Stone” is a registered trademark of Ashes to Stone, LLC, a North Carolina limited liability company.
6. Limitation of Liability
In no event will Ashes 2 Stone’s total liability exceed the purchase price paid for your order.
Some jurisdictions do not allow limitations on liability. If such laws apply, our liability will be limited to the minimum extent permitted.
7. Indemnification
You agree to indemnify and hold harmless Ashes 2 Stone, its employees, and affiliates from any claims, losses, damages, expenses, or costs (including attorney fees) arising out of your use of our site, products, or services.
8. Arbitration
You agree that any dispute, claim, or controversy arising out of or relating to your relationship with Ashes 2 Stone—including these Terms, your use of the site or services, or related privacy or publicity rights—shall be resolved exclusively through binding, individual arbitration. Arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules.
- You and Ashes to Stone LLC waive the right to a jury trial.
- Discovery and appeal rights in arbitration are more limited than in court.
- You may not bring or join any class, representative, or consolidated action against Ashes to Stone LLC.
This arbitration agreement is governed by the Federal Arbitration Act. If AAA cannot hold a hearing within 160 days of filing, either party may request arbitration instead with Judicial Arbitration and Mediation Services (“JAMS”). Arbitrators may not award damages or remedies inconsistent with these Terms. A court of competent jurisdiction may enter judgment on the award.
9. Governing Law and Jurisdiction
These Terms and your relationship with Ashes 2 Stone shall be governed by the laws of the State of North Carolina, without regard to conflict of law rules.
Subject to the Arbitration section above, you agree that any legal action relating to these Terms shall be filed exclusively in the state or federal courts located in Alamance County, North Carolina, unless otherwise required by law.
